Licence Terms

This is a licence agreement between you and Tender Photos that explains how you can use photos (individually and collectively, “content”) that you license from Tender Photos. By downloading content from Tender Photos, you accept the terms of this agreement.

Description of Terms:
  • “Rights-Managed” licences are limited to the specific use, medium, period of time, print run, placement, size of content and territory selected, and any other restrictions that accompany the content on the Tender Photos website (or Image Store).
  • “Non-exclusive” means that you do not have exclusive rights to use the content. Tender Photos can licence the same image to other clients.
  • “Editorial” use means that the image is mainly intended to be used for news reporting, discussion of current affairs, and illustration of other human interest stories. This covers both print or digital materials, including newspapers, magazines and books (except for covers), editorial broadcasts, documentaries, non-commercial websites, blogs and social media posts illustrating matters of public interest. It excludes book or magazine covers, commercial, promotional, advertorial, endorsement, advertising, or merchandising purposes in any media (e.g. print, commercial broadcast, film, digital).

  1. Grant of Licence: Tender Photos grants you a non-exclusive, non-transferable licence to use the content for the permitted purposes described in this agreement. This licence is personal to you and may not be assigned or sublicensed to any other person or entity.
  2. Permitted Uses: You may use the content for editorial, non-commercial purposes only. This includes using the content in your own creative projects, social media posts, presentations, and other personal applications. You may not use the content for any commercial purposes, such as selling products or services that incorporate the content, without prior written permission from Tender Photos. 
  3. Restrictions: You may not modify, adapt, translate, create derivative works of, or otherwise alter the content in any way. You may not resell, redistribute, or sublicense the content to any third parties. You may not use the content in a way that infringes on the copyright, trademark, or other intellectual property rights of Tender Photos or any third parties.
  4. Copyright and Trademark: The content is owned by the named photographer and is protected by copyright and trademark laws. You may not remove, alter, or obscure any copyright, trademark, or other proprietary notices that are part of the content. Tender Photos retains all right, title, and interest in and to the content, and you acquire no ownership interest in the content through this agreement.
  5. Attribution: You must include a credit next to the content or in production credits. The credit should be in the following manner: “[Photographer Name]/Tender Photos.”
  6. Termination: This agreement and the licence granted herein will terminate automatically if you breach any of the terms or conditions of this agreement. Upon termination, you must destroy all copies of the content in your possession or control. Tender Photos reserves the right to terminate this agreement at any time and for any reason.
  7. Limitation of Liability: In no event shall Tender Photos be liable for any indirect, special, incidental, or consequential damages arising out of or related to your use of the content, even if Tender Photos has been advised of the possibility of such damages. Tender Photos's total liability to you shall not exceed £100 GPB.
  8. Governing Law and Jurisdiction: This agreement shall be governed by the laws of England and Wales, and any disputes arising hereunder shall be resolved in the courts of the United Kingdom.
